Partnerships and S corporations

Elective pass-through entity tax under R.S. 47:287.732.2 (LAC 61:I.1001): S corps and entities taxed as partnerships may elect to pay Louisiana income tax at the entity level; election made on Form R-6980 and the electing entity files Form CIFT-620 (electronic filing mandatory). A partnership that makes the election is not required to file Form IT-565. Composite partnership return (Schedule 6922) required for nonresident partners without a valid agreement unless the PTE election is made.

Sales and use tax

Due date. Return (Form R-1029) due on or before the 20th day of the month following the close of the calendar month or quarter reporting period.

Filing frequency. Monthly by default; LDR may approve quarterly filing on application.

Thresholds. Dealers whose sales tax liability averages less than $500 per month after filing six returns may apply to file quarterly.

Notes

Louisiana is unusual in using the 15th day of the FIFTH month (May 15) for corporate, partnership and S-corp returns. Franchise tax repeal confirmed on LDR's own FAQ page. The LDR partnership-tax landing pages returned 404; the IT-565 instructions (tax year 2022 edition) were used for the partnership due-date rule.

What we could not confirm. LDR pages did not state which Act repealed the franchise tax (Act 6 vs Act 12 of the 2024 3rd ES) so the act number rests on Grant Thornton. Sales tax filing-frequency rule is only the LDR FAQ's '$500/month average after six returns to go quarterly'; no published monthly/annual thresholds beyond that. The IT-565 instruction PDF fetched is the 1/23 (tax year 2022) edition; the due-date rule has not changed since but a newer edition was not retrieved.
